Documents: all documents (if applicable) must be completed in full by buyers and sellers. For example: death certificates, letters of authority, creditor liens, Federal firearm laws, and UCCs when purchasing vehicles, firearms, etc. b) Chevy truck will not be allowed on the highway but will be demonstrated on both preview dates.  Chevy Truck: Truck runs & appears to be well maintained and in good working condition. Truck payment is to be made in full within 24 hours of close of auction either by check, cash, or wire transfer.  If paying with check the estate will retain the truck until check clears the auctioneer’s escrow account, then and only then possession is given to purchaser.  If paying by cash or wire transfer, possession given upon payment received.

Firearm & Truck Terms Continued:

A representative of the estate will accompany the purchaser to the county court clerk’s office (Western KY area) for the transfer of the title unless the title is leaving the state, in this case the title will be mailed.   Firearms: Firearms will be available for preview Sat., April 25^th 10AM – to 12PM only.  All other previews can be arranged through the office by appointment.  All firearm buyers will be required to adhere to all Federal Firearm Laws (FFL) in conjunction with a KY licensed Federal Firearms Dealer working in conjunction with this sale. All successful firearm purchasers will be given the name & the address of the FFL Dealer in Paducah, KY to make arrangements for pickup. Out-of-state buyers will be required to have any and all firearms shipped to an FFL Dealer.  Proof of purchase required/invoice.  FFL Dealer will charge a $25.00 processing fee per firearm.  Additional fees may apply if shipped.

 
BUYERS, PLEASE MAKE NOTE AND UNDERSTAND THE FOLLOWING TERMS. CHRIS COLSON AUCTION & REALTY CO LLC CHARGES A 10% BUYER’S PREMIUM ON ALL INTERNET PURCHASES. ALL INTERNET BUYERS ARE REQUIRED TO HAVE A VALID CREDIT/DEBIT CARD ON FILE WITH PROXIBID. Buyers must register prior to bidding and must be of legal capacity to enter into this agreement. All bidders must provide their name, company (if applicable), mailing address, physical address, phone number and email address prior to the auction. 10% Buyer’s Premium & KY 6% sales tax will be added to all sales for each lot.

Auction Terms: 

This is a timed online only absolute auction. By registering for this auction and bidding you agree to all the terms and conditions listed above & below.

1. Lien-free title delivered on Chevy truck once payment is collected and has cleared the auctioneer’s escrow account.  Delinquent taxes (if any) will be paid by the estate.  If a clear title or lost title has to be reapplied for through Frankfort, a 45-day grace period will apply to provide a good title or your money back.   


2. All tax exemptions must be sent to the office prior to invoices being paid. No refunds will be given for sales-tax exemptions once payments are processed. Please inform us if you are tax exempt. Resale certificates must be on file with the auction company in advance of sale day.  Ky sales tax is 6%.  NOTE: (all vehicle taxes will be collected at the time of registration, NOT AT THE AUCTION)


3. Occasionally an item must be removed from the auction due to circumstances beyond our control. If there is an item that you are interested in, please call ahead of time to ensure that it is still registered into the auction.


4. Currency Accepted: Credit or debit cards only.  Payment by credit/debit card is due upon the closing of the auction on ALL ONLINE BIDS except for truck and home.


5. Previews:  Saturday, April 25^th 10 A.M. – 12 P.M. & Thursday, April 30^th 3 P.M. - 5 P.M.


6. Invoice/paid receipt notifications may be automatically blocked or put into a deleted/junk/ spam folder. It is the bidder's               responsibility to contact us regarding their invoice if it is not received within a 24-hour period.


7. The online listing catalog is to be used a guide and guide only, its accuracy cannot in any way be guaranteed or warranted. No sale shall be invalidated or void, nor shall auctioneer be liable for any inaccuracies in the catalog and each bidder assures that all lots were available prior to the offering for pre-inspection prior to bidding.


8. When the bidder bids on an item and is accepted it is a LEGALLY-BINDING AGREEMENT, and as such is not removable. 


9. Auctioneer shall not, for any reason be responsible for loss, theft, or damage of any kind to any items purchased, the item’s security and protection solely reside with the purchasers.


10. The amount owed to the auction company will be carefully and accurately represented and shown on a company generated invoice, no 3^rd party invoice or receipt communications shall be considered binding nor accepted as amount owed.  Invoice/s will be sent to purchaser/s disclosing the total purchase price. 


11. If payment by credit card is not collected immediately upon the close of the auction, purchaser may be assessed late penalties and/or including being reported to HIBID for nonpayment and you will be blocked from any further bidding.
    


12. All items are subject to being pulled from the auction up to and including day of the auction for any reason that auction company deems fit, without prior notification.


13. Pickup: All items are expected to be picked up on a designated day following the auction. That day will be Saturday, May 9^th between the hours of 8 A.M. & 5 P.M. but is subject to change.  All bidders will be notified if pickup date must be changed.  Any items not picked up within the described window and/or prior arrangements have not been made and acknowledged by the auction company in writing, will incur storage and handling fees and will be sold ABSOLUTE in our next auction at the new owner's expense. All fees and charges including storage and commissions will be deducted from the sales price and the balance will be sent to them in the form of a company check mailed to their address on file.
    


14. Warranty: Online inventory and any auction-day catalogs are guides only, auction company is not responsible for incorrect information online or in catalogs. The auction company uses the most up-to-date resources to collect any and all info for specifics. Special preview appointments can be made by calling Chris Colson Auction & Realty Company.  All information is gathered from what is believed to be reliable sources and is believed to be correct but not guaranteed. Bidders will hold harmless Chris Colson Auction & Realty Co. LLC and its representatives.  Chris Colson Auction & Realty Co. LLC assumes no liability for errors or omissions in the listings of any of the merchandise included in this auction including year, type, manufacturer, make, model, usage, they are represented but unverified information and accuracy is not guaranteed.  Chris Colson Auction & Realty Co. 16. Auctioneer reserves the right to refuse any bid for any reason which they consider to be an insignificant advance over the preceding bid or is not in the best interest of the seller.


17. Items will be available for preview based upon the times noted in the terms. Previewing the items is always recommended prior to bidding as all bidders are solely responsible for personally inspecting the item and verifying any information presented here or elsewhere. Items and their descriptions are subject to change, correction, updating and/or cancellation at any time without notice.


18. This auction is being performed online and controlled by an independent 3rd party, and as such the functionality of the third party’s site is in no way the responsibility of Chris Colson Auction & Realty Co. LLC, thus no bidder may hold Chris Colson Auction & Realty Co. LLC responsible for missed bids, electronic transmissions sent from the 3rd party, nor technology challenges experienced prior to, on the day of auction, nor after the auction. Electronic communications between you the bidder and the bidding platform are just that- communications between you and the bidding platform. Chris Colson Auction & Realty Co. LLC is in no way liable nor expected to honor the automatically generated communications from 3rd party entities. It is encouraged, to guarantee your bid is received, that you place your maximum bid via the proxy bid option 24 hours in advance.


19. It is the bidder's responsibility to know which item they are currently bidding on.  The item becomes the property of the winning bidder.


20. No items will be released under any circumstances unless all cost, fees, and taxes are paid in full and all signed paperwork if any has been returned. This is an absolute auction - ALL SALES ARE FINAL!
    


21. By registering for this auction, you are authorizing Chris Colson Auction & Realty Co. LLC to use for their sole discretion your contact information to collect balances and contact you for promotion or advertising.
    


22. All disputes or legal matters if any should arise will be addressed in mediation prior to other proceedings and will be conducted in KY.
